Massapequa Man Arrested for Aggravated DWI with Children in Vehicle
The Nassau County Police Department reports an arrest of a Massapequa man for Aggravated Driving While Intoxicated (Leandra’s Law) on Wednesday, July 12, 2023 at 12:35 AM in Uniondale.
According to Police, Officers on routine patrol observed a grey Dodge RAM 1500 that committed several Vehicle Traffic Infractions and conducted a Vehicle and Traffic Law stop near the intersection of Hempstead Turnpike and Cunningham Avenue.
Officers approached the vehicle and observed the driver, defendant Marvin Villafuerte, 36 of 8 Ford Drive West, with glassy eyes and the smell of alcohol emanating from his breath. Officers conducted a Standard Field Sobriety Test with positive results and defendant Marvin Villafuerte was placed under arrest without incident.
The vehicles passengers, two juveniles ages five and six, were both released into the custody of a family member that responded to scene.
Defendant Marvin Villafuerte is charged with two counts of Aggravated Driving While Intoxicated (Child under 16) under the Leandra’s Law, two counts of Endangering the Welfare of a Child, Driving While Intoxicated and multiple Vehicle and Traffic Infractions. Defendant Marvin Villafuerte will be arraigned on Wednesday, July 12, 2023 at First District Court, located at 99 Main Street, Hempstead.
