Suffolk County Police last night arrested a woman for Leandra’s Law for driving while intoxicated following a single-vehicle crash with a 7-month-old and a 7-year-old in the vehicle.
Kimberly Diaz was driving a 2000 GMC Yukon, with her two sons as passengers, eastbound on the Sunrise Highway Service Road, west of Maple Avenue, when she lost control of the vehicle and crashed into a utility pole at approximately 9:20 p.m.
When Suffolk County Police Highway Patrol officers arrived at the scene, they determined Diaz was intoxicated and arrested her. The two boys were transported to Stony Brook University Hospital for treatment of minor injuries. They will be released to the custody of a grandparent.
Diaz, 27, of 141 Calvert Lane, West Babylon, was charged with Aggravated Driving While Intoxicated with a Child Passenger 15 Years Old or Younger (Leandra’s Law), Felony Driving While Intoxicated, Circumvent Interlock Device, Aggravated Unlicensed Operation of a Motor Vehicle and two counts of Endangering the Welfare of a Child. She will be held overnight at the Seventh Precinct and scheduled for arraignment at First District Court in Central Islip later today.
