Please read these Terms of Service (TOS) carefully before using LongIsland.com Gold Card. The words, "Company", "We" and "Us" refers to LongIsland.com., an online media company. The word "Card(s)" shall mean {} Gold Cards as the case may be as issued by the Company. The terms / words not explicitly defined herein shall hold their literal meanings. These TOS supplements and is in addition to the Terms and Conditions applicable to the use of LongIsland.com website.

1.Product Definition

LongIsland.com's Gold Card is a club membership entitles you to exciting offers & discounts at your favourite hangouts: Cinemas, Pubs, Restaurants, Shopping, Spas, Weekend Getaways & a lot more.

Just show up at the merchant’s outlet and produce your LongIsland.com Gold Card before the final bill is presented. You will receive a discount of upto 25*% on your bill.

• The LongIsland.com Gold Card does not restrict you to ANY payment method, so you can pay by cash, credit card (any bank) or any other method that the merchant accepts.

2.Acceptance Of Terms

a) LongIsland.com's Gold Cards are subject to the TOS and the Terms and Conditions applicable to the product. The TOS are subject to review from time to time. Use of the service for issuing the Gold Card constitutes your acceptance of the terms and you agree to abide by it.

You can review the most current version of the TOS at any time on LongIsland.com. In addition, when using LongIsland.com's Gold Cards, you shall be subject to any guidelines or rules applicable to the cards that may be posted from time to time at the same web site.

You agree that issuance of LongIsland.com's Gold Card to you will represent your acceptance of this TOS, and that continued use of LongIsland.com's Gold Card after revisions to this TOS shall constitute your agreement to such revised terms and any applicable posted guidelines or rules.

b) Unless explicitly stated otherwise, any new features that augment enhance or otherwise change LongIsland.com's Gold Card shall be subject to this TOS.

c) LongIsland.com. reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, LongIsland.com's Gold Card (or any part thereof) with reasonable notice.

d) The Company shall not be responsible for interception/ misuse of LongIsland.com's Gold Card. The Company is not liable if the card falls into wrong hands due to any reason whatsoever and or if the terms and conditions relating to use of cars is not complied with.

3.Your Registration Obligations:

While buying & using the card, you agree to:

a) provide true, accurate, current and complete information about yourself as prompted by the card registration form ("Registration Data"), and

b) maintain and promptly update the Registration Data to keep it true, accurate, current and complete.

4.Registration

a. In order to issue or use LongIsland.com’s Gold Card, you must provide certain information as may be required, by the Company to validate your identity.

b. If you are unable to provide adequate information to validate your identity, we have the right to not allow you to register for LongIsland.com’s Gold Card.

c. If you do not successfully register for LongIsland.com’s Gold Card, the merchant may not accept your card for DISCOUNT during transaction subject to card.

5.Authentication

The Company at a later date may provide features for any additional authentication. The Card member agrees to validate such requirements at a future date.

6.Card Security

You are solely responsible for maintaining the confidentiality of Registration Data and other verification information established by you with respect to LongIsland.com’s Gold Card, and all activities & transactions that occur using your card.

You agree not to transfer or assign your use of, or access to the card to any third party. You agree to immediately notify us in the event of loss of card. You acknowledge and agree that, except as otherwise provided by Applicable Law or in the Terms & Conditions applicable to the card, we shall not be liable for any loss or damage arising from your failure to comply with this TOS.

7.Privacy Of Registration Data

a. Your Registration Data will not be shared with any online retail merchants or merchants in other transactions for which LongIsland.com Gold Card is used.

b. You acknowledge and agree that Company may keep your Registration Data and also may disclose your Registration Data if required to do so by Applicable Law, in the good faith belief that such preservation or disclosure is permitted by Applicable Law, or as reasonably necessary to (i) comply with legal process or (ii) enforce this TOS.

8.Conduct Guidelines

You agree NOT to:

a. Impersonate any person or entity using the LongIsland.com Gold Card;

b. Spam or flood the LongIsland.com Gold Card website or service;

c. Modify, adapt, sub-license, translate, sell, reverse engineer, decompile or disassemble any portion of the LongIsland.com Gold Card website or service.

d. Remove any copyright, trademark, or other proprietary rights notices contained in the card;

e. "Frame" or "mirror" any part of the cardservice without LongIsland.com’s prior written authorization;

f. Otherwise interfere with, disrupt or violate this TOS or any requirements, procedures, policies or regulations of LongIsland.com Gold Card or of any networks connected to the card; or

g. Intentionally or unintentionally violate any applicable local, state, national or international statute, regulation, regulatory guideline or judicial or administrative interpretation, or any rule or requirement established by Company (all of which shall constitute "Applicable Law") in connection with your use of LongIsland.com Gold Card

9.Liability

a. Under no circumstances will the Company be liable for consequential, incidental, special or indirect losses or other damages resulting from your use of LongIsland.com Gold Card.

10.Card Validity & Acceptanc

a. LongIsland.com’s Gold Card issued to you shall be valid for a period 1 year from the date of issue.

b. LongIsland.com’s Gold Card shall be valid and acceptable at all the outlets of the Merchant Partner, unless otherwise specified on Merchant’s page

c. LongIsland.com’s Gold Card shall be acceptable on ALL the days/seasons throughout the year, except for few dates/days specified on Merchant’s page

d. The exclusive offer/discount percentage offered by Merchant Partner may vary during the year. We’ll always ensure that we get you the best deal throughout the year.

e. LongIsland.com’s Gold Card benefits CAN NOT be clubbed with any other loyalty programs/ membership card of Merchant Partner

11.Dealings with Merchants

Your communication or business dealings with, or participation in promotions of, online, retail or any other merchants through LongIsland.com Gold Card, including payment, exclusive LongIsland.com members discount & delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such merchant.

You agree that, except as otherwise provided by Applicable Law or in our Terms and Conditions applicable to the card, we will not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings. You understand that use of LongIsland.com Gold Card does not, in any way, indicate that we recommend or endorse any merchant, regardless of whether the merchant participates in LongIsland.com Gold Card. For example, LongIsland.com does not verify the identity of the merchant or the quality of the merchant's goods or services.

12.Disclaimer Of Warranties

You expressly understand and agree that except as otherwise required by any applicable state law, we make no representations or warranties about LongIsland.com Gold Card of any kind, express or implied, including any warranties as to merchantability or fitness for a particular purpose.

13.Miscellaneous

Indemnity

ou shall indemnify the Company for and against all losses and damages that may be caused as a consequence of breach of any of the LongIsland.com Gold Card Terms of Service mentioned herein above under.

Withdrawal of Facility

The Company shall be entitled to withdraw the above service at any time whatsoever.

Fees & Charges

You hereby agree to bear the charges as may be stipulated by the Company for availing the Card services. LongIsland.com’s Gold Card membership fee is non-refundable & non-transferable.
