Suffolk DA: Babylon Man Sentenced To 16 Years To Life In Prison For Residential Burglary

Suffolk County District Attorney Raymond A. Tierney announced that Jose Osorio, 58, of Babylon, was sentenced today to 16 years to life in prison for a residential burglary that he committed in 2022 while he was out on parole for another crime.
 
“This defendant is a repeat offender whose history of getting caught, doing time in prison, and then being released on parole did not deter him from committing yet another home burglary,” said District Attorney Tierney. “This sentence solidifies our commitment to seek significant prison sentences for recidivists in order to protect the citizens of Suffolk County.”
 
On November 30, 2022, Osorio pleaded guilty before Supreme Court Justice, the Honorable Timothy P. Mazzei, to Burglary in the Second Degree, a Class C violent felony. He was represented by the Legal Aid Society.
 
According to the evidence, on May 4, 2022, Osorio broke into a home in Babylon through a basement window and stole numerous items. One of the items he stole - a key fob for a vehicle - was equipped with an Apple air tag, which allowed the Suffolk County Police Department to track its location to the vicinity of the Osorio’s address. After further investigation, Osorio was arrested at a local pawn shop, where he was attempting to sell proceeds of the burglary.
 
Subsequent to his arrest, members of the Suffolk County Police Department recovered additional proceeds of the burglary during a search of Osorio’s home. 
 
Osorio’s criminal history includes two prior violent felony convictions. In 1995, he was convicted of Burglary in the Second Degree, for which he was sentenced to four to eight years in prison, and in 2003, he was convicted of Attempted Burglary in the Second Degree, for which he was sentenced to 12 years to life in prison. Osorio was released to parole supervision in 2019.
 
This case was prosecuted by Assistant District Attorney William L. Richards III of the Major Crime Bureau.
