NCPD: Elmont Man in Police Custody After Recklessly Firing Handgun at Trespassers on His Property

The Fifth Squad reports the arrest of an Elmont man for an incident that occurred on Monday, March 24, 2025 at 3:20 a.m. in Elmont.
 
According to Detectives, Officers responded to First Street in Elmont for a Shot Spotter activation. Officers located a vehicle at scene with two bullet holes, a second vehicle with a smashed window, and a neighboring fence and garbage can sustained bullet holes. 
 
Upon further investigation, it was determined that defendant, David Leary, 62, of 430 First Street, witnessed several suspects in his driveway tampering with his vehicle. He exited his home and discharged several rounds from a firearm. 
 
No injuries were reported at scene and defendant was arrested without incident. 
 
Defendant Leary is charged with Criminal Possession of a Weapon 2nd Degree, Reckless Endangerment 1st Degree, Criminal Possession of a Firearm, Prohibited use of a Firearm, and two counts of Unlawful Possession of Certain Ammunition Feeding Devices. He will be arraigned on Tuesday, March 25, 2025 at First District Court, 99 Main Street, Hempstead.
