Rockville Centre, NY - March 25th, 2014 - Biomet M2a Magnum hip replacement recipients have been filing lawsuits alleging that the artificial joint has been failing prematurely and causing severe adverse side effects. Cases brought to federal courts continue to increase, based on numbers provided by the U.S. District Court for the Northern District of Indiana, where a multidistrict litigation has consolidated over 1,200 of those lawsuits (In re: Biomet M2a Magnum Hip Implant Products Liability Litigation – MDL No. 2391). According to the most recent court update issued on March 13, 2014, there are now at least 1,268 active Biomet lawsuits, 120 of which have been filed since February. The increase in the number of lawsuits could possibly be attributed to the announcement of a $56 million settlement that has been offered to plaintiffs. The deadline established for Biomet hip recipients to be included in the settlement is April 15. The base amount to be awarded to plaintiffs who qualify will be $200,000, although the company maintains that its metal-on-metal hip replacement devices are not responsible for the injuries the lawsuits allege. In order to receive compensation, plaintiffs had to have received a Biomet M2a 38, or M2a Magnum device, that failed more than 180 days after implantation.
