Bayville Couple Charged with Assaulting Landlord at His Residence, According to Police

Second Squad Detectives report the arrests of a Bayville man and woman for Burglary that occurred in Bayville.
 
According to Detectives, defendants Johnathan Sunderland, 31, and Jennifer Garcia, 25, attempted to confront their landlord at his residence. As the defendants were knocking on his door, a female victim, carrying her one year old child started opening the door. Both defendants pushed open the door, knocking the female and her child to the ground. Defendant Sunderland charged the male victim and threw him to the ground. Sunderland then got on top of the victim and began choking him as defendant Garcia was kicking the male victim in the face. Both defendants then left the residence and were followed outside by the female victim. While in the driveway, Sunderland removed a pellet handgun from his waistband and fired four shots at the female victim, missing her with all four shots. As police arrived both defendants were arrested without further incident. The male victim was transported to an area hospital for treatment and the female victim and her child were not injured.
 
Defendant Johnathan Sunderland has been charged with Burglary 2nd Degree, Assault 3rd Degree, Menacing 2nd Degree, Criminal Obstruction of Breathing and Endangering the Welfare of a Child. Defendant Garcia has been charged with Burglary 2nd Degree, Assault 3rd Degree and Endangering the Welfare of a Child. Both defendants were arraigned at First District Court, 99 Main Street in Hempstead.
 
A criminal charge is an accusation. A defendant is presumed innocent until and unless proven guilty.
